Official Rules
(the “Official Rules”)

1. Sponsor and Select Definitions

The “Sponsor” is Shop 4 Charity Inc.. The Sponsor in its sole and absolute discretion may engage various third parties to handle various aspects of the Sweepstakes on its behalf. In these Official Rules, where the context permits or requires, the term “Sponsor” includes those third parties.

“Sweepstakes Draw Code” means a unique 10-digit alphanumeric code starting with the letters “SC” that evidences entry into the Sweepstakes and will be used for draw purposes. The “Entry Code” is a 12 digit alphanumeric code that is provided to the purchaser when a Super Calendar (defined below) is purchased through a corporate program or retail outlet. All times mentioned in these Official Rules are Pacific Time (“PT”) unless otherwise specified. The “Entry Period” begins on September 16, 2016 at 12:00:01 a.m. PT (i.e. midnight) and ends on December 16, 2016 at 11:59:59 p.m. PT.

2. Eligibility

The Sweepstakes is open only to individuals who are: (a) legal residents of Canada; (b) over the age of majority in his/her province or territory of residence; and (c) physically located within Canada at the time of entry.

You are NOT eligible to enter the Sweepstakes if, at any time on or after September 1, 2016, you are or were: (a) a director, officer, employee, representative or agent of Sponsor, or Deloitte LLP (“Deloitte LLP”), any of their respective parent, subsidiaries, affiliates, or service agencies, any entity engaged in the development, production or distribution of materials for the Sweepstakes, or any other entity engaged in the promotion, advertisement, administration or execution of this Sweepstakes (collectively the “Sweepstakes Entities”); or (b) the member of any immediate families (defined as parents, siblings, children, and spouses, regardless of where they live) or households (whether or not related) of any of the foregoing such persons.

The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Sweepstakes. Failure to provide such proof may result in disqualification.

3. How To Enter

No purchase or payment is necessary to enter or win. A purchase will not increase your chances of winning.

A. To Enter the Sweepstakes with Purchase: To enter the Sweepstakes with purchase, go online to sweepstakesforthecure.ca/orderformone.aspx (the “Official Website”) or call 1-800-949-4103, or by mail, submit an order form to Shop4Charity 2017 January Super Calendar Sweepstakes, P.O. Box 10, Brockville, ON, Canada K6V 5T8 and purchase a January 2017 Super Calendar (the “Super Calendar”). Purchaser must provide their own, or alternate Super Calendar recipient’s, full name, complete address, and telephone number (including area code). Once you have provided the requisite information and completed the purchase transaction, the Super Calendar recipient will be automatically entered and will receive one (1) unique Sweepstakes Draw Code evidencing such Entry (“Entry” and collectively, the “Entries”) for each Super Calendar. Super Calendar(s) including the unique Sweepstakes Draw Code(s) evidencing entry into the Sweepstakes will be mailed to the recipient specified in the order within twenty (20) business days from order date. If Super Calendar(s) and/or Sweepstakes Draw Code(s) are not received within twenty-five (25) business days, purchaser (or recipient, if different) should contact the Sponsor to follow up on the order.

B. To Enter the Sweepstakes without Purchase: To enter the Sweepstakes without purchasing a Super Calendar, send a hand-written Entry by mail to: Shop4Charity 2017 January Super Calendar Sweepstakes, P. O. Box 10, Brockville, ON, Canada K6V 5T8, Attn: January Super Calendar Sweepstakes Entry. Your Entry must be legibly hand-printed or written on a blank 8.5” x 11” piece of paper, and must include: (a) an original essay of 200-250 words about why you think it is important to support breast cancer research and awareness (the “Essay”); and (b) your full name, complete mailing address, telephone number (including area code), and a valid email address. Each Essay must be a hand-printed, original composition by the entrant, written specifically for the Sweepstakes. You must also include your return address on the exterior of the envelope, which must be legibly hand-printed in ink. Each Entry must be in a separate outer stamped envelope. Entries that are photocopied, hand-stamped, computer-generated, or otherwise mechanically produced or reproduced, without a legible postmark, or that are not printed or written manually in ink, will NOT be honoured and will be deemed void. Upon receipt of a valid Sweepstakes entry request, you will receive one (1) Entry into the Sweepstakes, and will receive a unique Sweepstakes Draw Code evidencing such Entry for each valid request received. The Sweepstakes Draw Code will be emailed to each entrant within twenty (20) business days from receipt of the valid request. Please check your email and spam filters. If Sweepstakes Draw Code is not received within twenty-five (25) business days please contact the Sponsor. LIMIT: one (1) FREE Entry per person per day during the Entry Period. Each Entry request must be in a separate outer stamped envelope, postmarked during the Entry Period, and must be received no later than December 28, 2016.

C. To Enter the Sweepstakes with an Entry Code (Corporate Program and Retail Outlets): Individuals may alternately have the opportunity to enter the Sweepstakes through a corporate program or retail outlet. Super Calendars may be pre-purchased by corporate partners and distributed by such partners for free to individuals selected in the corporate sponsor’s sole discretion. Super Calendars distributed via this method will include a unique 12 digit alphanumeric entry code (each an “Entry Code” and collectively, the “Entry Codes”). Upon receipt of a Super Calendar, the recipient must go to the following page on the Official Website, sweepstakesforthecure.ca/supercalendar/activateform.aspx, enter the Entry Code along with the individual’s full name, complete address, telephone number (including area code), and a valid email address. Once you have submitted the requisite information you will receive one (1) Entry, and will receive a unique Sweepstakes Draw Code evidencing such Entry, for each unique and valid Entry Code submitted. Sweepstakes Draw Code(s) will be emailed to each entrant within twenty (20) business days of entry. Please check your email and spam filters. If Sweepstakes Draw Code(s) is not received within twenty-five (25) business days please contact the Sponsor. LIMIT one (1) Entry per Entry Code.

D. General: Each Sweepstakes Draw Code and Entry Code can only be used one (1) time. All Entry Codes and Sweepstakes Draw Codes shall be subject to verification and shall be null and void if they are found to not have been obtained or submitted in accordance with these Official Rules. Sponsor is not responsible for late, lost, damaged, mutilated, garbled, undelivered, or postage due Sweepstakes Draw Codes, Entry Codes or Entry requests. No mechanical reproductions of Entry Codes or Sweepstakes Draw Codes permitted. Use of automated devices is prohibited; automated Entries (including but not limited to Entries submitted using any robot, script, macro or other automated service) are not permitted and may result in disqualification. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and by the decisions of the Sponsor in respect to the Sweepstakes, which decisions shall be final and binding with respect to all aspects of the Sweepstakes. In the event of a dispute as to the identity of the person who submitted any only Entry, the authorized account holder of the e-mail address submitted at entry will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an access provider, service provider, or other person or organization responsible for assigning e-mail addresses for the account associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.

4. Winner Selection

On December 30, 2016 at 9:00 am PT (i.e. 12:00 noon ET) at 400 Applewood Crescent, Suite 500, Vaughan, ON L4K 0C3, Deloitte will randomly select one (1) potential winner from among all Entries received during the Entry Period as eligible to win for each of the thirty-one (31) days in the month of January 2017. Each selected entrant will be notified by telephone within five (5) business days of the day for which his/her Entry was selected. All potential winners must satisfy the prize claim conditions set out below to be eligible to win.

5. Prize Claim Conditions

Before any potential winner can be declared a winner, he/she must first (i) correctly answer a time-limited mathematical skill-testing question (the “Skill-Testing Question”) without assistance of any kind whether mechanical, electronic or otherwise, and (ii) read, execute and return a declaration of eligibility/release of liability (the “Prize Claim Document”) to the redemption centre (the “Redemption Centre”) by the date indicated on the Prize Claim Document.

Once the potential winner is contacted, the Sponsor will schedule a mutually convenient time for the Sponsor to administer the Skill-Testing Question to that individual, which must occur within eight (8) business days from the date of first contact. Following which, and provided the potential winner correctly answers the Skill-Testing Question, the Sponsor will send that potential winner (via regular mail delivery and/or email to the addresses confirmed by the potential winner) the required Prize Claim Document that the potential winner will be required to complete and return to the Redemption Centre, in a postage-paid envelope which the Redemption Centre will provide to him/her, by email or by fax. The Prize Claim Document will contain, among other things, a declaration of eligibility and compliance with the Official Rules, a liability release and a publicity release and must be actually received (properly completed and signed by the potential winner) by the Redemption Centre on or before a date which the Redemption Centre will specify to the potential winner. When the Redemption Centre receives the completed Prize Claim Document, the Redemption Centre will begin the verification process described in these Official Rules. It is planned that the Redemption Centre will inform the applicable entrant, if he/she is not a verified winner, within approximately twenty (20) business days from the date the completed Prize Claim Document and any other required materials are actually received by the Redemption Center. If the potential winner is verified as a winner, the Redemption Center will award the prize.

Return of any prize or winner notification as undeliverable, inability to reach selected entrant or failure of selected entrant to respond to notification within five (5) business days of first attempt by Sponsor, failure to provide proof of eligibility (if requested), Prize Claim Document, or other required documentation by the deadline provided with the documents, failure to correctly answer the Skill-Testing Question, or other non-compliance with these Official Rules may result in disqualification, forfeiture of the prize and, at the Sponsor’s sole discretion, selection of an alternate entrant who will be eligible to win the forfeited Prize, subject to disqualification in the same manner described above. In the event an entrant is so disqualified, the entrant will have no claim against the Sponsor or any other person respecting the forfeited prize or the Sweepstakes.

All information requested by and supplied to the Sponsor for the purpose of the Sweepstakes must be truthful, complete, accurate, and in no way misleading. The Sponsor reserves the right; in its sole discretion to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate, or misleading personal details and/or information, and may require return or repayment of any prize awarded.

6. Prizes

There are thirty-one (31) prizes available to be won, one (1) representing each day of the month of January 2017. The odds of winning depend on the number of eligible entries received during the Entry Period. Each prize consists of a cheque payable to the verified winner in the amount of $10,000.

7. Limitations of Liability

By participating in the Sweepstakes, entrants releases and agrees to hold the Sweepstakes Entities, and every director, officer, employee, agent, manager and member of any one or more of the Sweepstakes Entities harmless from and against any and all costs, injuries, losses or damages (including without limitation direct, indirect, incidental, consequential or punitive damages) of any kind, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or in any activity related to the Sweepstakes, or due in whole or part to the receipt, possession, use or misuse of any prize. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you.

Without limiting the generality of the foregoing, the Sweepstakes Entities are not responsible for illegible, misdirected, lost, damaged, late, incomplete or stolen Entries, Entry requests, and/or submissions of Prize Claim Document, which may be judged as void; for any damage to a Entrant’s computer system or wireless device which is occasioned by accessing the Official Website, by participating in the Sweepstakes, or by redeeming or attempting to redeem a prize; for interrupted, inaccessible, lost, incompatible or unavailable networks, servers, satellites, internet service providers, wireless carriers, websites (including the Official Website), or other connection; for availability or accessibility problems arising in connection with or over the course of the Sweepstakes or any matter related to the Sweepstakes; for miscommunications, scrambled, jumbled, failed, delayed or misdirected computer, telephone or cable transmissions, or hardware or software malfunctions, failures or difficulties; postal delays or other mail disruptions; for any technical malfunctions, failures, or difficulties, printing errors or omissions clerical, typographical or other error(s) or omissions in any materials connected to Sweepstakes including, without limitation, the Entry Code, Sweepstakes Draw Codes, Prize Claim Document, , communication whether written or oral, the offering or announcement of any Prize or in any Prize notification or email or letter; for any errors or omissions or failures of any kind, whether human, mechanical, clerical, electronic, interruption of power, or technical in nature; or, for the incorrect or inaccurate capture of information, or the failure to capture any information.

Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors. In the event of any discrepancy between any printed materials and these Official Rules, the terms of these Official Rules shall govern. The Sweepstakes materials (including Entries) and Prize Claim Document submitted are the sole property of the Sponsor and will not be returned. Entrants assume all risk of loss, damage, destruction, delay and misdirection of Prize Claim Document and are advised to obtain insurance.

8. General Disclosures

A. Power or Other Interruptions affecting Sweepstakes Entry: If there is a power or a computer-related interruption of any nature whatsoever before an Entry Code, which an Entrant has attempted to enter into the Sweepstakes, has actually been received and recorded by the Sweepstakes Computer, it is possible that the Entry Code may have been lost, and consequently forfeited. When power is restored or the interruption corrected, the Entrant who experienced the interruption should sign in to the Official Website and try to enter the applicable Entry Code to determine if that Entry Code or was received and recorded by the Sweepstakes Computer before the interruption occurred. If the applicable Entry Code was received and recorded by Sweepstakes Computer, an onscreen message will state that the Entry Code has already been entered into the Sweepstakes. The Sponsor is not responsible for any Entry Codes lost as a result of power or computer-related interruption.

By participating in the Sweepstakes and by submitting Prize Claim Materials, except where legally prohibited, each verified winner hereby agrees and grants the Sponsor the right, but not the obligation, to use his/her name, voice, and likeness, along with his/her address (city/town/village and Province/Territory) and any statements made by or attributed to such Winner in any and all media (including the internet), now known or hereafter devised, in perpetuity and throughout the universe, for advertising and promotional purposes in connection with the Sweepstakes without further notice, review, approval or compensation and releases the Sponsor and all directors, officers, employees, agents, advertising and promotional agencies, representatives, service agencies and independent contractors of the Sponsor from any and all liability with respect thereto.

B. Disqualification

It is each Entrant’s responsibility to ensure that he/she has complied in full with all the conditions and requirements contained in these Official Rules. The Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering or interfering in any way with the process involved in entering the Sweepstakes or with the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in any unsportsmanlike or disruptive manner, or with the apparent intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to any, abuse, threaten or harass any other person. The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.

C. Force Majeure/Printing and Production Errors or Omissions

The Sponsor has the following rights in respect to termination or modification of the Sweepstakes, subject only to the jurisdiction of the Régie des alcools, des courses et des jeux (the “Régie”) in the Province of Quebec. Sponsor reserves the right, without prior notice and at any time, to terminate Sweepstakes, in whole or in part, or to modify, suspend or extend the Sweepstakes in any way and for any reason. Without limiting the generality of the foregoing, the Sponsor may terminate the Sweepstakes, whole or in part, or modify, suspend or extend the Sweepstakes, if it determines, in its sole discretion, that the Sweepstakes is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, glitches, or printing or production errors or omissions) have destroyed or severely undermined the proper play, integrity, and/or feasibility of the Sweepstakes. In the event the Sponsor is impeded or prevented from continuing with the Sweepstakes as planned or intended by any event beyond its control, including, but not limited to fire, flood, natural or manmade epidemic or health hazard or crisis, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, provincial, territorial or local government law, order, or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the Sponsor’s control, then the Sponsor shall have the right to modify, suspend, extend or terminate the Sweepstakes. Only the number of prizes described in these Official Rules will be awarded in the Sweepstakes. The sole responsibility and liability of any irregular Entry Code or Sweepstakes Draw Code caused by the Sponsor is replacement with another randomly selected Entry Code or Sweepstakes Draw Code, as solely determined by the Sponsor. Replacement shall be the sole and exclusive remedy under such circumstance. If, due to printing or production errors or omissions or for any other reason whatever, the number of potential prize winners coming forward seeking to claim prizes exceeds the number of prizes as set out in these Official Rules, in the sole discretion of Sponsor, the winner may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s).

D. Waiver and Invalidity

Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that a provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference, and shall not be deemed or considered to affect in any manner the meaning or intent of these Official Rules or any provision thereof.

9. Privacy

Information provided by entrants in connection with the Sweepstakes will be used for the purposes of Sweepstakes administration and prize fulfillment, and will be collected, used, and disclosed in accordance with the Sponsor’s privacy policy, available at theshop4charity.ca/privacypolicy.

If you receive a Super Calendar and do not wish to be entered into the Sweepstakes, you may email us at customerservice@sweepstakesforthecure.ca or call 1-855-248-9831 to opt out and not receive an entry.

In consideration of being awarded a Prize in the Sweepstakes, each Prize winner agrees to the full extent permitted by law to participate fully and without compensation in any announcement(s) and/or presentation ceremony/ceremonies and/or event or events organized or presented by the Sponsor in its sole discretion related to the granting of the prize. The potential winner may be required to sign a document to this effect.

10. Residents of Quebec Only

Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
